Claims against developers – property defects (warranty)

Discovering defects in a property at the time of acceptance or after moving in often leaves buyers feeling powerless against the developer. In dealings with developers, buyers are usually at a disadvantage in negotiations, and discussions and attempts to resolve disputes amicably can be very difficult. Often, they also fail to produce the expected results.

Our experience shows, however, that when a buyer is represented by a professional attorney, this can significantly alter the course of the dispute and increase the chances of obtaining a favorable resolution. Real estate development agreements and property transfer agreements often contain complex and ambiguous contractual provisions that may not be fully understood by first-time property buyers. In practice, many of these provisions may be disadvantageous to the buyer; moreover, some of them may also constitute prohibited (unfair). These situations are of significant importance for the buyer’s legal security, especially considering that in the contractual relationship, the developer is usually the stronger party.
